Kihika Kimani's widow in fight with daughter over Sh600m property



The jury's ruling to swap her daughter as the victim's trustee with her daughter was rejected by a widow of the late Kihika Kimani, a former politician.High Court judge Rachel Ngetich's judgment of February 14, to substitute her in the Sh600 million estates as a trustee, criticized Margaret Wambui, first wife to Late Kihika, because Florence Nduta has nothing appealing before her.

Wambui, 90, has challenged the move and wants the ownership of the property from her third-born daughter Erishifa Wanjiru.The Judge determined that Nduta, together with her four stepmoms, would be a shared manager of her dad's properties.

Wambui, via their counsel, flaunted the court's decision once again when the lawsuit appeared on Friday 7 May.Wambui took the role of her other daughter Wanjiru on November 1st 2019 as a manager.She said that Wanjiru had a high concern and would aid her in managing part of the building.She recognized how she was old and well, and had to substitute her with a decent daughter.

"The first admin (Wambui) called for her daughter Wanjiru to step down and replace her, who will protect her property interests," she said.She further said that over the past 15 years she worked tirelessly and had dispensed roles honestly and equally with her staff.

"The beneficiaries accepted and signed an agreement to substitute their mother to show their interest in the suit property," she added.She said her last-born daughter, Nduta, cannot be trusted and indicated futher on that she had been trying,since 2018, to illegally take her place as the administrator.

After they had been provided with letters of administration on 13 October 2009, Wambui and her co-wives Alice Mukuhi, Marie Wangari and Miriam Warau had clung to administrative role since then.Just after the MP died on 19 November 2004, 78 years old, the widows took over the estate.However, they submitted requests in 2018 to be replaced as executives by their three children, Nduta (Wambui's), Anthony Kihika (Mukuhi's), and Judy Muthoni (Wangari's).

The kids believed that their moms were elderly, grouchy and incapable of performing the administrative duties.The four wives were against the request.They said that they were both healthy enough to manage the property for the other recipients.On 24 January 2019, Justice Anthony Ndung'u rejected the request. The children were unhappy and appealed on 17 April 2019. The Court of Appeal remains pending up to date with this appeal.

Fifty years before he passed, Wambui was married to Kihika.As from 2005, the successor's case is still pending up to date.Mentioning of the case will be on 31 May 2021.
